Transportify Data Privacy Policy

  1. Introduction

    In this Data Privacy Policy (the “Data Privacy Policy”), Deliveree Private Limited and its subsidiaries and affiliates are collectively or individually referred to as “Deliveree”, “we”, “our” and “us”.

    We are committed to protecting the privacy and security of personal data collected through its suite of software applications which include mobile Android and iOS mobile applications, websites, web applications, web forms, and other applications which are collectively or individually referred to as the “App”. We provide services described in our Customer Terms of Use document which can be found on our website and may be updated from time to time.

    This Data Privacy Policy outlines how we collect, use, disclose, process, transfer, and store your personal data, as well as the measures we take to comply with the Data Privacy Act of 2012 (R.A. 10173 or the “Act”) and its implementing rules. The Data Privacy Policy may be updated from time to time.

    Both this Data Privacy Policy and Customer Terms of Use documents can be found on our website (www.transportify.com.ph/information).

    You must review this Data Privacy Policy periodically. By continuing to use our App or Services, you are deemed to have reviewed and accepted all updates to the  Data Privacy Policy. If you do not consent to updates made to the Data Privacy Policy, you should not access our App or avail of the Services.

    This Data Privacy Policy applies to personal data of (jointly referred to as “you” or “your”):

    • “Visiting Users” refers to individuals who visit any of our physical offices or use any of our software applications including but not limited to our website, mobile applications, or web applications, and are not a Customer, Driver, or Agent as defined below.
    • “Customers” refers to individuals who avail or request for Services
    • “Drivers” refers to individuals who, through their own actions or through partner companies, provide/submit applications to us with the object of accessing our App to provide delivery services.

    • “Agents” refers to representatives of our business partners, business partners, and corporate business customers under our Business Program. 
  2.  Personal Data We Collect – we may collect the following personal data from you:

    • Device Information: Device model, operating system, IP address, location data (if enabled), App usage data, and advertising identification.
    • User Information: Name, email address, phone number, and social media account identifiers (if you choose to connect accounts).
    • Usage Information: Usage data, instructions, messages, and other information related to our services. 
    • Content Data: Photos, videos, text, contacts, or other content you upload or share through the App. Correspondence with us.
    • Payment Information: Payment method details (if you make purchases within the App or for us to make payments to you)
    • Additional for Agents: employment role information, company information, correspondence with us, payment/banking information, and copy of government IDs for KYC validations.
    • Additional for Drivers: photo of self, home address, copy of government IDs, photos of vehicles, copy of vehicle documents, date of birth, bank or mobile money payment information, emergency contact details, location tracking details.
  3.  How We Use Your Personal Data – we use your personal data for the following:

    • Providing and maintaining Services:
      • To create, update, and maintain your account in the App.
      • To enable transportation and deliveries through the App.
      • To track deliveries.
      • To process payments for services contracted via the App.
    • Improving the App: To personalize your experience, deliver features and functionalities, track app usage to improve functionality, and identify and fix bugs.
    • Communication: To send you important information about the App, information about your delivery bookings, updates, and occasional promotional offers.
    • Providing User Support: To respond to your inquiries and provide support as necessary.
    • Analytics and Research: To improve our services and develop new features in an anonymized or aggregated manner that does not identify individuals.
    • Email Marketing: we may use your personal data to contact you with newsletters, marketing or promotional materials, and other information that may be of interest to you. You may opt-out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email
    • Complying with Law and Regulations: 
      • To help maintain the safety, security, and integrity of all users of our App;
      • To comply with applicable laws, regulations, and legal processes, including reporting personal data upon lawful request from authorized Philippine authorities.
    • Additional for Agents: for business credit evaluation and signatory validation.
    • Additional for Drivers: for the processing of background checks.
  4.  Sources of personal data – we collect personal data via the following means:

    • Through our App
      • shared by you directly with us when you register for an account and create bookings and provide contact information of designated persons in each delivery location or 
      • created through your usage of the App and/or availing of the Services
    • Through our customer support representatives or any of our other employees with whom you interact via various communication channels such as, but not limited to chat software in our App, calls, SMS, other chat softwares, email, video conference calls, or face-to-face interactions. 
    • Through third parties such as service providers or business partners
    • Through referrals from our customers, drivers, employees, or agents
  5. Data Sharing and Disclosure – We may share your personal data with:

    • Delivery vendors performing delivery services for you via our app: We will share information, including personal information, that is necessary for delivery vendors to perform delivery service procured by you through our App for the purpose of facilitating delivery services.
    • Our employees, officers or independent consultants, auditors, or advisors. If the company is involved in any merger, acquisition or asset sale, your data may be transferred.
    • Third-party service providers: We may engage third-party service providers to assist us with providing the App, such as cloud storage providers, analytics providers, research partners, payment enablers, background check providers, identity verification providers, and customer support providers. These providers are only authorized to access and use your personal data as instructed by us.
    • Law enforcement and regulatory authorities: We may disclose your personal data if required by law, to comply with legal processes and active investigations authorized by the PNP, NBI, PDEA, DOJ, DILG, or Regular Courts, to protect our rights or property, or to prevent fraud or harm.
  6.  Data Security Measures – We implement appropriate technical and organizational measures to protect your personal data from unauthorized access, disclosure, alteration, or destruction:

    • Data encryption: We encrypt your personal data at rest and in transit using industry-standard protocols.
    • Access controls: Only authorized personnel have access to your personal data, with defined roles and permissions.
    • Organizational and physical measures: We have adopted organizational policies and physical measures to protect your personal data.
    • Security reviews: We regularly review our security practices to identify and address potential vulnerabilities.
    • International transfer of personal data: We may transfer your personal data to locations outside of your country/region. We will ensure that such transfer of your personal data takes place subject to this Data Privacy Policy.
    • In the event that we entrust your personal data with data processors, we will ensure that such data processors adhere to this Data Privacy Policy.
    • Data breach notification: We will promptly notify relevant authorities and individuals in case of a suspected data breach
    • Your access credentials: you are responsible for maintaining the confidentiality of the credentials to your account, including your passwords and the email or phone number associated with your registered account in our App
  7. Data Retention – We will retain your personal data for as long as it is necessary to fulfill the purposes for which it was collected, as required by law, or until you request its deletion. Personal data shall not be retained longer than necessary to fulfill the engaged services and purposes under Section 3.

  8. Your Data Protection Rights – You have the following rights regarding your personal data:
    • Right to access: You have the right to access the personal data collected and processed by us and obtain information about the processing of your personal data.
    • Right to rectification: You have the right to request the correction of inaccurate or incomplete personal data.
    • Right to erasure: You have the right to request the deletion of your personal data. However, under certain circumstances, we may be legally obligated or entitled to maintain it.
    • Right to restrict processing: You have the right to request the restriction of the processing of your personal data under certain circumstances, such as if you contest its accuracy.
    • Right to object: You have the right to object to the processing of your personal data for direct marketing purposes or on grounds relating to your particular situation.
    • Right to data portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format and to transmit it to another controller. You have the right to request a copy of the personal data that we have collected.
